Acceptance of these terms
These Terms of Use apply when you download or use Soundling, an application developed by Richard van der Dys. By using Soundling, you agree to these terms. If you do not agree, do not use the app.
What Soundling does
Soundling lets you record a short sound on your device and play that sound across a touch-based musical keyboard. Recordings and audio processing remain on your device and are not uploaded by the app.
Permission to use the app
You are granted a limited, personal, non-exclusive, non-transferable, and revocable license to use Soundling in accordance with these terms and the Apple Media Services Terms and Conditions. You may not copy, sell, redistribute, reverse engineer, interfere with, or exploit the app except where applicable law expressly permits it.
Your recordings and responsible use
You retain any rights you may have in sounds you create or record. You are responsible for ensuring that your recordings and use of the app do not violate another person’s privacy, intellectual-property rights, or applicable law.
Do not record another person without any consent required in your location. A parent or guardian should supervise a child’s use of the microphone when appropriate.
Microphone access
Recording requires microphone permission. You control this permission through iOS Settings. Soundling may have limited functionality if permission is denied or if the device does not provide compatible audio features.
Ownership
Soundling, including its software, design, artwork, name, and other original materials, is owned by Richard van der Dys or used with permission and is protected by applicable intellectual-property laws. These terms do not transfer ownership of the app to you.
Availability and updates
The app may be updated, changed, suspended, or discontinued. Future versions may require a newer version of iOS or a compatible device. Continued availability of every feature is not guaranteed.
No professional advice or guaranteed output
Soundling is a creative musical tool intended for entertainment and exploration. It is not a professional recording, tuning, educational-assessment, or safety service. Audio analysis and playback may vary depending on the sound, microphone, device, and environment.
Disclaimer
To the fullest extent permitted by law, Soundling is provided “as is” and “as available,” without warranties of any kind. Use of the app is at your own risk. Some jurisdictions do not allow certain warranty exclusions, so portions of this disclaimer may not apply to you.
Limitation of liability
To the fullest extent permitted by law, Richard van der Dys will not be liable for indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use Soundling. Nothing in these terms limits liability that cannot legally be limited.
Termination
Your permission to use Soundling ends if you materially violate these terms. You may stop using the app at any time by deleting it from your device.
Apple terms
Your use of Soundling is also subject to applicable Apple terms, including Apple’s standard end-user license terms. If these Terms of Use conflict with mandatory Apple terms, the applicable Apple terms control.
Changes to these terms
These terms may be updated when Soundling’s features or legal requirements change. Updated terms will be posted on this page with a new effective date. Continued use after an update constitutes acceptance where permitted by law.
